Terms and conditions of sale

Scope, price, lead time, delivery and liability for the AI visibility audit.

1. Scope

These terms govern the sale of the AI visibility audit offered by Fyher, a French SARL with a share capital of €1,000, registered office at 19 rue Saint-Grégoire, 50170 Servon, France, registered with the Coutances Trade and Companies Register under number 802 928 986.

This service is reserved for professionals — companies, sole traders, associations — acting in the course of their business. It is not intended for consumers.

Placing an order implies unreserved acceptance of these terms.

2. What the service covers

The audit measures a brand's presence in the answers given by AI assistants. It includes:

The scope is fixed. Questions are written from the information the client provides in the order form; their relevance depends on how precise that information is.

The audit is a diagnosis. Implementing the recommendations is not included: Fyher writes no content and does not act on the client's site or on any third-party platform. The recommendations are advice based on the measurements taken; acting on them is the client's responsibility.

3. Price and payment

The price of the audit is €149 excluding VAT.

Applicable VAT is calculated at payment time based on the client's country. Clients established in the European Union outside France holding a valid EU VAT number benefit from the reverse charge mechanism.

Payment is made online, in a single instalment, by card via Stripe. The order is firm once payment is captured. An invoice is issued automatically and sent by email.

4. Lead time

The report is delivered by email within 48 business hours of payment being captured, to the address given at the time of ordering.

This lead time is indicative. Should it be significantly exceeded through Fyher's fault, the client may request a full refund.

5. Client obligations

The client undertakes to provide accurate information about their business, website and markets. Incorrect or insufficient information may lead to unsuitable questions, for which Fyher cannot be held liable.

The client has 24 hours after ordering to report an error, by replying to the confirmation email. After that, the measurement campaign may already have started and can no longer be changed.

6. Nature of the results — best-efforts obligation

Fyher is bound by a best-efforts obligation, not an obligation to achieve a specific result.

As the service is reserved for professionals acting in the course of their business, the statutory consumer right of withdrawal does not apply.

8. Ownership and use of the report

The report is assigned to the client for use by the client and its own service providers. Public distribution, resale or reproduction for commercial purposes require Fyher's prior written consent.

Fyher retains ownership of its methodology, tools and report templates. Fyher reserves the right to use measurement data in anonymised and aggregated form, in a way that does not allow the client to be identified.

9. Liability

Fyher's liability, on any grounds whatsoever, is limited to the amount actually paid by the client for the order concerned.

Fyher cannot be held liable for interruptions, changes or unavailability of the third-party AI services queried, nor for decisions taken by the client on the basis of the report.

Data processing is described in our privacy policy.

11. Governing law and disputes

These terms are governed by French law.

In the event of a dispute, the parties will endeavour to reach an amicable settlement. Failing that, the dispute will be brought before the courts having jurisdiction over Fyher's registered office.
